House Commerce and Energy committee has five bills on Jan 23

Wind-TurbinesOn Friday, January 23rd, at 10:00 AM the House Commerce and Energy committee will take up five bills.

HB 1033 – Repeal the South Dakota Energy Infrastructure Authority.

The Governor’s Office of Economic Development (GOED) asked for this bill. Normally I would oppose anything GOED does, since it basically is a department used by the executive branch to pick winners and losers in the market. But in this case I don’t see a problem with repealing the South Dakota Energy Infrastructure Authority. Looking at the website it appears no activity has happened there for years.

HB 1034 – Repeal certain outdated and unnecessary statutes related to the Wind Energy Competitive Advisory Task Force.

Another GOED bill. This task force seems to have expired a couple years ago. Just seems to be cleaning up code.

HB 1037 – Revise certain provisions related to the regulation of public utilities.

The Public Utilities Commission (PUC) asked for this bill. This bill adds LLC to the definition of person. It also updates the language of people who can appear before the PUC. This is the second time this year I’ve seen language updated to include LLC as a person, apparently that was missed in the past.

HB 1038 – Revise certain provisions related to the siting of energy facilities.

Another PUC bill. This one seems to be removing the language distinguishing transmission substations of two hundred fifty kilovolts or more. The new language doesn’t differentiate.

HB 1027 – Revise certain provisions regarding the regulation of certain money lending activities.

This bill was first heard by the Committee on Jan 21 (my post for that meetings bills). Here are my previous notes on the bill:

One last DLR bill for the day. Part of this bill appears to be related to HB 1028 (from above). It adds the definition of “nationwide mortgage licensing system and registry” to the Money Lending Licenses portion of SD law (§ 54-4). Also it adds code to deal with the nationwide mortgage licensing system and registry.

This bill also changes money lending licenses from expiring on July to December 31. This bill also expands upon the power of the Director to suspend or revoke licenses.

This bill was amended on the 21st. The amendment expanded upon the restricts of what a debt collector can do.
