Week 2 of the SD 2015 Legislature has completed. Not much really happens to bills during the first two weeks of session. Most of the committees spend their time hearing updates from various state agencies. And the majority of the bills that are taken up by committees and passed onto the floor are generally department bills.

But there are some bills, commemorations, and resolutions that have passed the floor in either body. Below is an update of what actually has passed through the House or Senate so far. There are also some bills that have made it to the floor and not moved yet.

Friday, Jan 16, 2015:

Senate

SB 28SoDakLibery PostsAuthorize the Board of Regents to sell certain extraneous real property to the City of Brookings, to deposit the proceeds in the school and public lands trust for the benefit of South Dakota State University, and to declare an emergency. This bill has been fast-tracked to allow the City of Brookings to build a new shop. It was actually scheduled to be taken up on the House floor on Jan 23. However it was deferred until Jan 26 (legislators love getting out early on Friday, can’t really blame them).

Tuesday, Jan 20, 2015:

House

HC 1001 – SoDakLibery Posts – Commending and honoring Jim Hagen in Pierre, South Dakota, for receiving the State Tourism Director of the Year Award.

Senate

SB 35 – SoDakLibery Posts – Repeal certain outdated and unnecessary statutes and rules related to the Department of Veterans Affairs. This bill has passed the Senate and been assigned to the House State Affairs committee.

SB 23 – SoDakLibery Posts – Revise certain provisions regarding the ownership and management of the South Dakota Art Museum. This bill is being pushed through to help the SD Art Museum keep its accreditation. This bill passed the Senate and has been assigned to the House State Affairs committee.

Wednesday, Jan 21, 2015:

House

HB 1006SoDakLibery Posts – Allow bullheads to be used as bait. This bill was placed on the consent calendar. It was asked to be removed and voted on the house floor individually on Jan 22.

HB 1014SoDakLibery Posts – Repeal certain obsolete and unnecessary statutes relating to the Department of Environment and Natural Resources. This bill has passed the House and been assigned to the Senate Ag & Natural Resources committee.

HB 1045SoDakLibery Posts – Revise certain provisions regarding licensure of dentists and dental hygienists and registration of dental auxiliaries. This bill has passed the House and will be heard in the Senate Health & Human Services committee on Jan 28.

HB 1058SoDakLibery Posts –  Revise certain provisions regarding contagious disease control quarantine measures and to declare an emergency. This bill has NOT passed the House. It was deferred until the DOH could come up with an amendment that could pass the floor. This deferment actually annoyed me. It means those of us in the public couldn’t hear any debate about the bill.

HB 1059SoDakLibery Posts – Allow authorized entities to access immunization information in certain circumstances. Another bill that has NOT passed the House. It was also deferred because it is seen as contentious.

HC 1002SoDakLibery Posts – Honoring Hunter Paulsen, a senior at Elk Point-Jefferson High School, for his outstanding accomplishments in the sport of cross country.

HC 1003SoDakLibery Posts – Commending and honoring the Alcester-Hudson Cubs football team on an outstanding season in 2014.

Senate 

SB 31 – SoDakLibery Posts – Revise certain provisions regarding coordination of benefits between health plans. This has passed the Senate and been assigned to the House Commerce & Energy committee.

SB 12 – SoDakLibery Posts – Allow the spouse of an active duty military person to qualify as a resident for a temporary permit to carry a concealed pistol. This bill has passed the Senate and been assigned to the House Judiciary committee.

SB 15 – SoDakLibery Posts – Allow for discretionary appeals of illegal sentences. This bill has passed the Senate and been assigned to the House Judiciary committee.

SB 18 – SoDakLibery PostsEstablish certain administrative provisions regarding charitable raffles, lotteries, and bingo and to make violations of these provisions subject to the Deceptive Trade Practice and Consumer Protection Act. This bill has passed the Senate and been assigned to the House Judiciary committee.

SB 58 – SoDakLibery Posts – Revise certain authority, monetary penalties, and hearing procedures of the South Dakota Commission on Gaming. This bill has passed the Senate and been assigned to the House State Affairs committee. I still partially believe the huge penalty increases in this bill are a possible attempt to grab more revenue from the gaming industry.

House

HB 1015 – SoDakLibery Posts – Repeal certain provisions regarding the South Dakota Risk Pool. This bill has passed the House, it has yet to be assigned a committee in the Senate.

HB 1035 – SoDakLibery Posts – Revise certain provisions regarding military specialty plates. This bill has passed the House and assigned to the Senate Transpiration committee.

HB 1036 – SoDakLibery Posts – Codify legislation enacted in 2014. This bill has passed the House and assigned to the Senate Judiciary committee.

HB 1024 – SoDakLibery PostsRepeal certain outdated and unnecessary statutes related to the Department of Labor and Regulation. This bill has passed the House and assigned to the Senate Commerce & Energy committee.

SB 30 – SoDakLibery Posts – Revise the review process for rate and policy form filing denials for insurers. This bill was on the consent calendar for this day, but was asked to be removed.

SB 36 – SoDakLibery PostsRepeal certain outdated and unnecessary statutes and to update certain references related to the Department of Tourism. This bill passed the Senate and has been assigned to the House State Affairs committee.

HB 1017 – SoDakLibery Posts – Repeal certain outdated and unnecessary provisions related to the Department of Revenue. This bill passed the House and is on its way to the Senate.

HB 1019 – SoDakLibery Posts – Revise certain provisions regarding exemptions from sales and use taxation of farm machinery, attachment units, and irrigation equipment used exclusively for agricultural purposes. This bill passed the House and is on its way to the Senate.

HB 1031 – SoDakLibery Posts – Repeal certain provisions regarding former state-owned rail lines. This bill passed the House and is on its way to the Senate.

HB 1018 – SoDakLibery Posts – Revise the sales and use tax exemptions for farm machinery. This bill was deferred until Jan 26.

HB 1012 – SoDakLibery Posts – Revise certain provisions regarding child welfare agencies. This bill was deferred until Jan 26.

SB 34 – SoDakLibery Posts – Revise certain provisions concerning the administration of benefits provided to veterans and to declare an emergency. This bill passed the Senate and is on its way to the House. This bill was amended on the Senate floor to give it an emergency clause.

SB 67 – SoDakLibery Posts – Revise certain provisions regarding challenges to certain election petition signatures. This bill was deferred to Jan 26.

SB 21 – SoDakLibery Posts – Revise the income guidelines for the paraplegic property tax relief program. This bill was deferred to Jan 26 after previously being removed off the consent calendar.

SC 1 – SoDakLibery Posts – Celebrating and honoring Tabor’s Annual Czech Days festivities on the occasion of its sixty-seventh anniversary on June 18, 19, and 20, 2015.

SC 2 – SoDakLibery Posts – Commending and honoring Dr. Curtis R. Johnson as the 2014 USA Section President of the International College of Dentists, for his dedicated volunteer service, and for his devotion to the medical profession.
