Senate State Affairs has 6 bills on Fri Jan 30

HB 1051 – SoDakLiberty PostsRevise various trust and trust company provisions.

This bill passed the House State Affairs committee and House floor with no opposition. Here are my notes preceding the House State Affairs meeting:

This bill originates from the Department of Labor and Regulation. There are a lot of changes made in this bill. Some of the changes are to clean up the code. But a lot of it also changes various aspects of trusts. This might be one worth listening to testimony on to determine the why the DLR thinks all of these changes are necessary.

SB 49 – SoDakLiberty PostsAuthorize the Department of Game, Fish and Parks to sell a portion of railway right-of-way to the City of Deadwood.

The SD Department of Game, Fish and Parks (GFP) asked for this bill. This would allow the GFP to sell real property in Deadwood.

SB 112 – SoDakLiberty Posts – Revise certain provisions regarding voting rights of a person convicted of a felony.

Sen Tieszen (R, Dist 34) is the Senate prime sponsor of this bill. This bill has caused a bit of a stir already. Current SD law doesn’t allow a felon who is “serving a sentence” to vote. This bill would change that to “imprisoned”. That would mean a felon out on parole trying to be a good citizen can now vote; and not wait until their entire sentence is done. Personally I think this is a good change to current law.

SB 113 SoDakLiberty Posts – Revise certain provisions regarding the fiscal impact statements prepared for legislation that impacts state prison or county jail populations.

Sen Brown (R, Dist 23) is the Senate prime sponsor of this bill. This one appears to be a word cleanup bill.

SB 84 – SoDakLiberty PostsLimit the authority of delegates to a limited Article V convention to vote for unauthorized amendments contrary to legislative instructions and to provide a civil fine for the violation thereof.

Sen Otten (R, Dist 6) is the Senate prime sponsor of this bill. This is the senate version of Rep Stalzer’s bill HB 1069. I oppose this bill just as I do the House version of the bill. See this post as to why.

SJR 1 – SoDakLiberty Posts – Making formal application to Congress to call an Article V convention of the states for the sole purpose of proposing a federal balanced budget amendment.

Sen Otten (R, Dist 6) is the Senate prime sponsor of this Joint Resolution. This is the senate version of Rep Stalzer’s Joint  Resolution HJR 1001. I oppose this resolution just as I do the House version of the resolution.
