Senate Tax has five bills on Fri Jan 30

HB 1016 – SoDakLiberty Posts – Revise certain provisions regarding references for auditing standards used by the Department of Revenue.

This passed the House Tax and House floor with no opposition. Here are my notes about the bill preceding the House Tax meeting:

The Department of Revenue (DOR) asked for this bill. It is a simple bill that changes the auditing standards used by the DOR from 2014 to 2015.

HB 1017 – SoDakLiberty Posts – Repeal certain outdated and unnecessary provisions related to the Department of Revenue.

This passed the House Tax and House floor with no opposition. Here are my notes about the bill preceding the House Tax meeting:

Another DOR Bill. This one covers code in a few areas of codified law, including a provision dealing with horse and dog racing. This is a hearing that will have to be listened to in order to determine what is actually going away. But at a glance nothing raises any red flags.

HB 1018 – SoDakLiberty Posts – Revise the sales and use tax exemptions for farm machinery.

This passed House Tax with no opposition. Rep Hickey did vote Nay to this on the House floor. Here are my notes about the bill preceding the House Tax meeting:

Yet another DOR bill. This one appears to clarify the farm machinery Sales & Use tax exemption. I simply points code at other current code with a list of exemptions. Personally I think the exemptions need to go away altogether and let everyone pay the same Sales & Use tax on everything.

HB 1019 – SoDakLiberty Posts – Revise certain provisions regarding exemptions from sales and use taxation of farm machinery, attachment units, and irrigation equipment used exclusively for agricultural purposes.

This passed the House Tax and House floor with no opposition. Here are my notes about the bill preceding the House Tax meeting:

One last DOR Bill. This bill clarifies sales tax exemptions for farmers. Among the changes is the added references multiple times of the equipment must be used for agricultural purposes. I would say this is the DOR trying to crack down on people getting agricultural sales tax exemptions when they shouldn’t be.

SB 93 – SoDakLiberty Posts – Impose a gross receipts tax on the rental of certain motorcycles in lieu of the excise tax on motor vehicles.

Sen Solano (R, Dist 32) is the Senate prime sponsor of this bill. The code this bill is modifying actually renames “provision” to “tax” in part of the code (although it does say tax in another part, it was likely an error). It also adds new code references to the vehicles it applies to.
