House Judiciary has three bills on Fri Feb 6

6thOn Friday, February 6th, at 10:00 AM the SD House Judiciary committee will take on 3 bills.

HB 1173 – SoDakLiberty PostsDeter certain frivolous appeals of land zoning decisions.

Rep Lee Qualm (R, Dist 21) and Sen Gary Cammack (R, Dist 29) are the prime sponsors. This would allow the court to award costs and expenses to the defense if it is found the lawsuit was frivolous or purposely was being done to hinder or delay the use of land in a way that had already been approved. These kind of laws are double-edged. I do agree the court system is used wrongly quite often, I just hope courts are very careful using power.

HB 1103 – SoDakLiberty PostsRevise certain provisions relating to comparative negligence.

Rep Mike Stevens (R, Dist 18) and Sen Arthur Rusch (R, Dist 17) are the prime sponsors. Out of my comfort area to even comment on.

HB 1142 – SoDakLiberty Posts – Revise certain provisions pertaining to the age requirements for sex offender registry registration.

Rep Peggy Gibson (D, Dist 22) and Sen Angie Buhl O’Donnell (D, Dist 15) are the prime sponsors. This bill adds “at the time of the offense” to someone who is fourteen or older to register as a sex offender (if they meet other requirements).
