House Commerce committee has five bills on Mon Feb 9

papapishu-Tools-1On Monday, February 9th, at 10:00 AM the SD House Commerce committee will take on 5 bills.

HB 1222 – SoDakLiberty PostsRevise certain educational requirements for state-certified residential appraisers and state-certified general appraisers.

Rep Burt Tulson (R, Dist 2) and Sen Jason Frerichs (D, Dist 1) are the prime sponsors. Right now to become a state-certified appraiser it requires a bachelor’s degree or higher. This would allow two other options: 120 months and 10,000 of appraisal experience  or having served as a county director of equalization for 10 years. Personally I think other areas of appraisal law need to be looked at. There is a serious shortage of appraisers nationwide, and most of it has to do with protectionist regulations keeping new entries out.

HB 1182 – SoDakLiberty PostsLimit the number of apprentices to be supervised by an electrician.

Rep Patrick Kirschman (D, Dist 15) and Sen Dan Lederman (R, Dist 16) are the prime sponsors. A simple bill… and a bad one. Here is the new provision being added:

There shall be a ratio of no more than three apprentices to each electrical contractor, journeyman electrician, or class B electrician on any job site.

This is not a case where government needs to come in and decide how many apprentices an electrician can handle at a jobs site. Coming up with an arbitrary number of three makes no sense. Each job site and situation is different. The apprentices in question are also a factor. This is not a place where the state needs to dictate further rules.

HB 1236 – SoDakLiberty PostsRevise certain provisions regarding commissions received by insurance producers.

The House Commerce and Energy committee is the sponsor of this bill. I”ll have to listen to this one.

HB 1178 – SoDakLiberty PostsProvide for the creation of an entity for the purpose of insurance contracts in certain instances.

Rep Jeff Partridge (R, Dist 34) and Sen Tim Rave (R, Dist 25) are the prime sponsors. Another one I’ll have to listen to in order to see if i understand it correctly.

HB 1180 – SoDakLiberty PostsRevise certain provisions regarding the regulation of captive insurance companies.

Rep Don Haggar (R, Dist 10) and Sen Bruce Rampelberg (R, Dist 30) are the prime sponsors. One more to listen to. The big change in this appears to be adding the definition for “Agency captive insurance company” and incorporating agency into the current code.
